1. These terms and your agreement
These Terms of Service ("Terms") form an agreement between NMG Career Partners ("we", "us", "our") and the individual who engages us ("you", "the client"). They apply from the point you enter into a partnership and the fee described in section 5 is received. Where we issue a written scope of work, that document and these Terms are read together, and the scope of work prevails on any matter it specifically addresses.
Completing a Career Future Assessment does not create an agreement, does not commit you to anything, and does not require payment or payment details.
2. Description of services and service levels
We provide one service, offered at three levels over a single term of 24 months. The term is the same at every level. What differs between the levels is the amount of work we perform on your behalf. The service covers:
- Understand. A personalized assessment of your qualifications, professional experience, current position, skills, technology exposure, compensation, location, working preferences and career ambitions.
- Research. Research into how AI, automation, technology and changing employer demand are affecting your profession, including relevant roles, salaries, skills, hiring trends and emerging pathways.
- Strategize. A written personalized career strategy, including career pathway research, skills-gap assessment and training and skills recommendations.
- Position. Resume optimization and professional positioning for the direction identified.
- Identify. Employer and vacancy research and the ongoing identification of opportunities, as described in section 4.
- Support. Application support where appropriate, employer outreach where appropriate and authorized, professional follow-ups, interview preparation and career decision support.
Identification and support are carried out on an ongoing basis for the full 24 months rather than as one-off deliverables. The scope of your partnership — target roles, industries, locations and working arrangements — is agreed with you in writing and may be adjusted by agreement during the term.
The three service levels. Each level includes everything in the level below it. The level you have purchased is recorded in your written scope of work and determines what we are contractually obliged to perform.
- Career Positioning (Level 01) — “Help me prepare.” Career Future Assessment and market research; a personalized career strategy; resume and professional profile optimization; career pathway and skills-gap analysis; an opportunity strategy prepared for you to run yourself; and Monthly Career Progress Reports for all 24 months. At this level we do not perform opportunity research, employer targeting or employer outreach on your behalf.
- Career Campaign (Level 02) — “Help me pursue opportunities.” Everything in Career Positioning, and in addition: active opportunity research; employer targeting and shortlisting; opportunities identified and presented to you as described in section 4; and ongoing campaign support and adjustment. At this level we research and present; approaches to employers are made by you.
- Career Partner (Level 03) — “Actively work with me toward the outcome.” Everything in Career Campaign, and in addition: direct employer outreach on your behalf, subject to the authorization requirements in section 9; continuous opportunity identification; application and positioning assistance; ongoing campaign management and professional follow-ups; and interview preparation and career decision support.
You may move to a higher level during your term as described in section 5. Moving to a lower level after a partnership has commenced is not offered.
3. Monthly Career Progress Reports
A Monthly Career Progress Report is a deliverable of every partnership at every service level. For each month of the term you receive a written report covering work completed, opportunities identified, relevant industry and market developments, AI and technology developments relevant to your profession, employers researched or approached where applicable, application or outreach activity where applicable, progress against your career strategy, and our recommendations for what happens next.
You will receive twenty-four reports, one for each month of the term. The content of a report reflects the work performed at your service level. We may also contact you between reports where we identify something we believe deserves your attention.
4. Opportunities identified and presented
Where your service level includes it — Career Campaign and Career Partner — we continue researching your market and identifying opportunities for the whole 24 months, and we present to you what we believe may be relevant, together with our reasoning. At Career Positioning, the opportunity strategy is prepared for you to run yourself.
- Presentation is not an offer. The identification or presentation of an opportunity does not constitute a job offer or guarantee of employment, and is not a guarantee that a vacancy exists, remains open or will be filled. Employment, interviews, compensation and other outcomes depend on individual circumstances, employer decisions and market conditions.
- You are under no obligation. You are under no obligation to pursue, apply for or accept anything presented to you. You may decline any opportunity for any reason or for none, and declining does not affect the partnership or the work we continue to carry out.
- Where you choose to pursue an opportunity, we support you as described in section 2, subject to the authorization requirements in section 9.
- Frequency is set by the market. The number and timing of opportunities presented depend on your profession, agreed scope, location and prevailing market conditions. We do not commit to presenting a minimum number in any period.
5. Service level, fees and payment
Every partnership runs for a single term of 24 months. The service is offered at the three levels described in section 2, and the Monthly Career Progress Reports described in section 3 are included in full at every level.
The fee for the service level you select is confirmed to you in writing before any payment is taken. It is a single one-time payment, made in advance. There is no monthly billing and no automatic renewal. Fees are stated in United States dollars (USD) and are exclusive of any applicable taxes.
- How the fee is confirmed. We confirm the fee in writing after your Career Future Assessment has been reviewed and the level has been recommended and agreed. Completing an assessment does not commit you to anything and does not require payment or payment details.
- When work begins. Work begins once payment has been received and your scope of work has been agreed.
- Method. Payment is processed by a third-party payment processor. We do not store full payment card details.
- Changing level. You may move to a higher service level during your term by paying the difference between the two confirmed fees. Moving to a lower level after a partnership has commenced is not offered. The 24-month term is not extended or shortened by a change of level.
- Third-party costs. Fees charged by independent training providers, awarding bodies or examination centers are separate from our fee, are set by those organizations, and are paid by you directly to them. See section 10.
6. Term of the partnership
Your partnership runs for 24 months, beginning on the date your scope of work is agreed and payment has been received. It ends at the earlier of the expiry of that term or termination under section 14.
The partnership continues for the full 24 months even if you accept a role during it. Accepting a position does not end the partnership automatically, and the work described in sections 2, 3 and 4 continues for the remainder of the term at your service level unless you ask us to stop or to pause. Equally, if you decline every opportunity presented, or remain in your current position for the whole term, the partnership continues unaffected.
7. Your obligations
- Accurate information. Information you give us about your experience, employment history, credentials, qualifications, compensation and eligibility to work must be accurate and complete.
- Timely responses. You will respond to us, and to employers and recruiters we introduce you to, within a reasonable time.
- Notifying us of outcomes. You will tell us promptly about any interview, offer of employment or acceptance arising from the work.
- Keeping us informed. You will tell us if your circumstances change in a way that affects the work.
- Employers to avoid. You will tell us of any employer, recruiter or contact you do not want approached, so we can exclude them.
- Your own conduct. You are responsible for your conduct in interviews and negotiations, and for any employment agreement you enter into. We are not a party to it.
8. Our obligations
- We will perform the work described in section 2 for your service level, and in your written scope of work, with reasonable professional skill and care, for the full 24 months.
- We will represent you accurately. We will not invent employment history, inflate tenure, or state that a qualification is held when it is not.
- We will seek your authorization before presenting your profile to any employer, recruiter or hiring contact, as set out in section 9.
- We will continue to research and identify on your behalf for the whole 24 months where your service level includes it, whether or not you have accepted a role and whether or not you have declined what we presented previously.
- We will report to you each month, as set out in section 3.
- We will handle your information in accordance with our Privacy Policy, and will not sell your personal information.
- We will tell you honestly where a target role or salary expectation appears unrealistic on the information available. Salary and market figures we provide are estimated ranges, not offers, valuations or predictions.
9. Authorization to present your profile
We will not present, send or otherwise disclose your professional profile, resume or personal details to any employer, recruitment agency, staffing firm or hiring contact without your prior authorization for that named approach. You will be told who we propose to approach before anything is sent.
You may give a standing authorization covering a defined category of approach, recorded in writing, and you may withdraw any authorization at any time by telling us in writing. We will act on that instruction immediately, but we cannot recall material already provided to a third party. We will not approach your current employer.
10. Third-party training providers
Where our recommendations identify training that may strengthen your position, that training is optional and is provided by an independent third party. NMG Career Partners is not a training provider. We do not deliver training, we do not award any qualification, and we do not control any provider's syllabus, pricing, delivery or assessment standards.
You enroll with and pay the provider directly, under the provider's own terms. Provider fees are separate from and additional to our fee, and we receive no part of them. A recommendation is not an endorsement or a warranty of any provider, course or credential. If you do not undertake any training, the work described in section 2 continues on the basis of your existing background.
11. No guarantee of employment
NMG Career Partners does not guarantee that you will receive an interview, an introduction to any particular employer, an offer of employment, employment, or any particular level of compensation, benefits, seniority, location or working arrangement. Hiring decisions are made by employers and are outside our control, as are market conditions, employer budgets and the timing of vacancies.
The identification or presentation of an opportunity does not constitute a job offer or guarantee of employment. Employment, interviews, compensation and other outcomes depend on individual circumstances, employer decisions and market conditions. Our commitment is to the work described in sections 2, 3 and 4, performed competently for the term of your partnership and reported to you. Examples and illustrative figures shown on our website describe general situations and are not a representation of what will happen in your case.
12. Confidentiality
We treat your partnership as confidential. We will not approach your current employer, and we will take reasonable care to avoid approaches to contacts or organizations you have told us could put your current position at risk. We will not disclose your information other than as permitted by these Terms and our Privacy Policy — that is, with your authorization, to service providers bound by contract, or where required by law.
You agree in turn to keep confidential any non-public information we share with you about our methods, materials, research or contacts, and not to use it for any purpose other than your own career.
13. Intellectual property
Materials we produce for you — your career strategy, your rewritten resume, your professional profile and your Monthly Career Progress Reports — are licensed to you for your own personal career use, on an unlimited and perpetual basis, from the point your fee is paid.
NMG Career Partners retains ownership of its underlying methods, templates, frameworks, research materials, website content and brand. You may not resell, publish or commercially distribute them, or use them to provide a similar service to others. You retain ownership of the information you provide to us, and grant us the license necessary to use it to perform the service.
14. Cancellation and suspension
Pausing by agreement. You may ask us to pause your partnership at any time. We will suspend outreach on receiving that request in writing. The unused portion of your term is preserved and resumes when you ask us to restart, provided the restart occurs within twelve months of the pause.
Cancellation by you. You may end your partnership at any time by telling us in writing. On cancellation we stop all outreach and no further work is carried out. The fee is payable in advance and is non-refundable once the engagement has commenced, reflecting that the research, strategy, positioning and outreach work is performed from the outset rather than at its conclusion.
Termination or suspension by us. We may suspend or end a partnership where you have provided information that is materially inaccurate or misleading, where you do not respond to us for a prolonged period despite reasonable attempts to make contact, where you ask us to represent you in a way that would be inaccurate or unlawful, or where your conduct toward our staff or our contacts is abusive. We will tell you in writing and explain the reason.
15. Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for hiring decisions. We have no liability for any decision made by an employer, recruiter or staffing firm, or for the terms, conduct or continuation of any employment you enter into.
- We are not liable for indirect loss, including loss of earnings, loss of opportunity, loss of profits or loss of reputation, however arising.
- Our aggregate liability is capped at the total fees you have actually paid to NMG Career Partners for the service.
- We are not liable for third-party training, including the acts, omissions, fees, content, delivery or outcomes of any independent provider or awarding body.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence. Except as expressly stated, the services are provided without warranties of any kind, express or implied.
16. Governing law
These Terms and any dispute arising out of or in connection with them are governed by the laws of the State of Texas, United States of America, without regard to its conflict of laws principles. The services are offered in the United States and are intended for individuals located in the United States.
17. Dispute resolution
If a dispute arises, please raise it with us first using the details in section 19. We will acknowledge your contact promptly and work with you in good faith to resolve it. If a dispute cannot be resolved within thirty days, the parties agree to attempt mediation in good faith before commencing proceedings, with the mediator agreed between them and the costs shared equally. Where a matter proceeds to court, the parties submit to the exclusive jurisdiction of the state and federal courts located in the State of Texas.
18. General
- Changes to these Terms. We may update these Terms and will revise the "Last updated" date when we do. The Terms in force when you enter into a partnership govern it.
- Entire agreement. These Terms, your written scope of work and our Privacy Policy form the entire agreement between us regarding the services.
- Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
- No waiver. A failure to enforce any provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign your rights under these Terms. We may assign them to a successor in connection with a merger, acquisition or sale of our business.
- Independent parties. Nothing in these Terms creates an employment, partnership, joint venture or agency relationship beyond the service described.
